Secretary of State Hargett and The BBB Warn Against Familiar Scam
The BBB recently added State Compliance Center, also known as SCC, to its list of “Misleading Advertising, Products and Services Middle Tennessee Consumers and Businesses Can Do Without.” The company received a “D-” BBB rating.
SCC is requesting businesses pay nearly $90 to obtain a Certificate of Existence/Authorization, also known as a Certificate of Good Standing. The request is being mailed out across the state on an official looking document.
The standard fee to obtain a Certificate of Existence directly from the Division of Business Services is $20.
Letters being sent by SCC make it appear as if a Certificate of Existence/Authorization is required by law, but it is important to note a certificate is not required to do business in Tennessee. Typically, a business requests a Certificate of Existence for specific business purposes, like obtaining a loan or entering into a contract.
SCC LLC is a registered business in the state of Tennessee, but is not affiliated or associated with the Division of Business Services.
Tennessee Secretary of State Tre Hargett has been warning consumers about similar scams for years. Other companies, including Corporate Records Services and Annual Business Services, sent out official looking documents to businesses in 2013 with claims they must pay filing rates higher than what the state actually charges.
“I encourage all businesses and organizations to contact the Division of Business Services directly if they have questions regarding how to obtain a Certificate of Existence, or if they receive questionable items in the mail,” Secretary Hargett said. “Business leaders should use caution anytime a third-party is seeking to file something on their behalf with the state.”
Whenever the Department of State receives information about a company with questionable practices the information is sent directly to the appropriate authorities.
Court Case Over The Method for Executing Prisoners Is Underway
After more than a year of delays, a trial challenging Tennessee’s method for executing prisoners has begun.
Steve Kissinger represents 33 death row inmates who say lethal injection is unconstitutional. In opening statements, Kissinger said the state’s use of prison guards to inject the drug creates a substantial risk that it will be administered incorrectly and cause extreme pain.
Assistant Attorney General Scott Sutherland countered that the U.S. Supreme Court has said inmates aren’t guaranteed a painless death. Sutherland says the execution method is cruel and unusual only if it involves things such as torture or the deliberate infliction of pain.
Tennessee has yet to carry out an execution using the questionable drug. But Sutherland says Texas, Ohio and Georgia have carried out more than 30 successful and painless executions with the drug.
The lawsuit is one of several challenges to various execution protocols nationwide.
Lawmaker Says Slow Down Before Removing Bust of Confederate General From The State Capitol
A Tennessee lawmaker says he plans to slow the effort to remove a bust of a Confederate general and Ku Klux Klan leader from the halls of the Tennessee Capitol. House Majority Leader Gerald McCormick told The Chattanooga Times Free Press that he thinks a calmer discussion is needed before a final decision is made. He said there has been a wave of “hysteria” over Confederate symbols since the recent massacre of nine people at a black church in South Carolina. The white suspect, 21-year-old Dylann Storm Roof, posed in photos displaying Confederate flags. McCormick said he still favors removing the statue and intends to talk about the bust when Tennessee’s State Capitol Commission meets July 17, but says the issue needs “a calm, reasonable discussion.”

BOBBY HUE MILLER, age 74, of Estill Springs, Tenn., departed this life Monday, July 6, 2015, peacefully at his residence.
Mr. Miller was born on October 11, 1940 in Cannon County, TN to the late Luther and Janie (Rogers) Miller.
Before retirement, Mr. Miller was employed by Coca-Cola where he was a pre-mixer. He was a member of the Christian Lighthouse Church in Tullahoma, TN and also, played the bass guitar for several gospel groups.
In addition to his parents, Mr. Miller was preceded in death by his sisters; Wynonna Prince and Wanda Partin.
He is survived by his loving wife of 22 years, Martha Miller of Estill Springs, Tenn., daughter, Teresa Golden and her husband, Tim of Tullahoma, Tenn., son, Troy Miller and his wife, Angie of Readyville, Tenn., step-daughter, Shannon Edwards of Winchester, Tenn., grandchildren, Dusty (Pam) Griffin, Alicia (Chris) Bewley, Steven (Kaycee) Edwards, great-grandchildren; Ethan Griffin and Kyrstyn Arthur.
Visitation with the family will be Wednesday, July 8, 2015, from 4:00 P.M – 8:00 P.M. at Grant Funeral Services.
Services will be held on Thursday, July 9, 2015, at 2:00 P.M. from the chapel of Grant Funeral Services with Bro. Bobby Watkins, officiating.
Interment will follow at New Brick Cemetery.

Terri Johnson Malloy 50, of Murfreesboro passed July 5, 2015 at Alive Hospice in Nashville.
She was the daughter of the late Percy Johnson, Jr and Anna Lee Johnson.
She was preceded in death by her father, Percy Johnson, Jr and Aunt Miriam Louise Johnson and Aunt Alberta Peterson.

Mrs. Patricia Ann Willard Barkve age 69, of Tullahoma, passed away Friday evening at Harton Regional Medical Center.
She was born in Murfreesboro, TN to the late Wiseman and Aline Bragg Willard.
Pat formerly worked for the Gupta’s here in Tullahoma, Harton Hospital and Medical Center of Manchester.
She is survived by her husband, Jerold Barkve, daughter, Cheryl Nelson, son, Eddie Barkve, sisters, Margie Robinson, Emogene Bellenfant, brothers, Wendal, Aubry and Samuel Willard, and grandchildren, Matthew Barkve, Jacob, Jared and Joshua Nelson.
Funeral services for Mrs. Barkve will be conducted at 10:00 AM, Friday at Tullahoma Funeral Home.
Graveside services will be conducted at 2:00 PM, Friday afternoon at Windrow Cemetery in Rockvale, TN.

Braves halt Brewers’ win streak at eight
Kelly Johnson’s two-run homer fueled the early offensive uprising the Braves used to cool off the red-hot Brewers and claim a 5-3 win Monday night at Miller Park. Milwaukee had won its past eight games.
The Braves, who have won five of their past six games, tallied a pair of runs in each of the first two innings against Kyle Lohse, who was fortunate to only allow four runs while surrendering 11 hits over five innings. Lohse surrendered hits, including a pair of A.J. Pierzynski doubles, to nine of the first 14 batters he faced, but he did not allow a run after the second.
“He hasn’t been able to get on a roll,” Brewers manager Craig Counsell said of Lohse. “He hasn’t had that start where it all kind of comes together. He’s had to fight his way through starts in almost all of his starts, especially recently.”
After gaining a 4-1 lead before he threw his first pitch in the second, Matt Wisler minimized the potential damage he encountered during the fifth and sixth. The Atlanta right-hander, who was making his fourth career start, limited the Brewers to three runs and seven hits over 5 2/3 innings.
“Getting those runs and jumping on them early kind of puts the momentum in our favor,” Wisler said. “It allowed me to go out there with a little more confidence knowing I didn’t have to go out there and shut them out.”
Johnson got the Braves rolling with his first-inning, two-run homer, which Statcast™ projected to travel 435 feet into the right-field seats. The veteran utility man added a second-inning RBI single to give him his second three-RBI game in the past three days. He entered Saturday with three RBIs over his past 59 at-bats. Brewers outfielder Gerardo Parra got Milwaukee on the board in the first, smacking his eighth career leadoff home run into the right-center-field bullpen. It was his third leadoff homer this season. Parra, a potential trade candidate, entered Monday batting .335 (74-for-221) since April 25, ranking him behind only Bryce Harper (.365) and Paul Goldschmidt (.360) in the National League.
After a line drive single and stolen base by shortstop Jean Segura in the fifth, pinch-hitter Shane Peterson blooped a two-out single into left field, scoring Segura. It was only Milwaukee’s second of three runs. The Brewers had averaged over seven runs a game during their eight-game winning streak, never scoring fewer than four.
“I don’t think we had that big rally, necessarily,” Counsell said of Milwaukee’s offense. “We put a runner on base in a couple of innings, but we were still some damage away from making something happen.”
After retiring 13 of the first 15 batters he faced after Parra’s leadoff homer, Wisler retired just three of the final nine batters he faced. Andrelton Simmons’ strong pinpoint throw to the plate prevented Peterson from scoring a second run for the Brewers in the fifth. The Braves’ rookie starter followed Ryan Braun’s sixth-inning leadoff double with consecutive strikeouts, but then allowed Carlos Gomez’s RBI single. His effort was preserved by Atlanta’s bullpen, which worked 3 2/3 scoreless innings.
Pierzynski doubled in his first two at-bats and later added a pair of singles to give him his second four-hit game of the season. The 38-year-old catcher had not recorded two four-hit games in a season since 2012.
Manny Banuelos will take the mound when Atlanta and Milwaukee resume he three-game series Tuesday at 7:10 p.m. CT. Banuelos completed 5 2/3 scoreless innings against the Nationals in his Major League debut Thursday. He was forced to exit because of dehydration that cause his fingers and left calf to cramp.
